These Terms incorporate the MotoArk Returns, Refunds & Warranty Policy, Delivery & Shipping Policy and Privacy & Cookie Policy.
1. Introduction and Acceptance
These Website and Marketplace Terms & Conditions (the "Terms") govern access to www.motoark.com, MotoArk applications and related services (together, the "Platform") and purchases made through the Platform. The Platform is operated by MotoArk FZE, Trade Licence No. SC251029901, registered at Block C, VL13-118, Sharjah Research, Technology and Innovation Park (SRTI Park), Sharjah, United Arab Emirates.
By accessing the Platform, creating an account, placing an order or otherwise using MotoArk services, you agree to these Terms, the Returns, Refunds & Warranty Policy, Delivery & Shipping Policy and Privacy & Cookie Policy, together with any product-specific or seller-specific terms shown before purchase.
If you do not agree to these Terms, do not use the Platform or place an order.
2. About the MotoArk Marketplace
MotoArk is a marketplace and automotive spare-parts trading platform focused on genuine automotive components, including genuine pre-owned OEM parts. Depending on the listing, MotoArk may act as the direct seller or may facilitate a transaction between a customer and a verified third-party seller.
Where a third-party seller supplies the product, that seller is responsible for the authenticity, lawful origin, description, condition and functional performance of the product and for seller-attributable remedies. MotoArk establishes marketplace standards, administers payments and customer support, and manages return/warranty claims. Nothing in these Terms excludes any independent responsibility imposed on MotoArk by applicable law.
3. Eligibility and Accounts
- You must be at least 18 years old and legally capable of entering into a binding contract to place an order.
- You must provide accurate, current and complete account, delivery and vehicle information.
- You are responsible for safeguarding your account credentials and for activity carried out through your account, except where caused by MotoArk security failure.
- Business customers must ensure that the person placing the order is authorised to act for the business.
4. Product Listings, Genuine Parts and Used Condition
MotoArk requires sellers to list products accurately and to comply with marketplace authenticity and sourcing standards. Used OEM parts may show reasonable signs of prior use, including cosmetic marks, scratches, discoloration, prior identification marks and other characteristics consistent with age and use.
Photographs, descriptions, part numbers, mileage, donor-vehicle information and condition grades are intended to assist purchasing decisions. Minor cosmetic differences that are disclosed or reasonably expected in a pre-owned part do not necessarily constitute a defect.
Third-party trademarks and vehicle manufacturer names are used solely to identify compatibility, OEM origin or vehicle application. Unless expressly stated, MotoArk is not affiliated with, endorsed by or authorised by the vehicle manufacturer.
5. Compatibility, VIN and Part Numbers
The customer is responsible for providing accurate vehicle information. VIN, OEM part number, production date, engine and other data may be used to assist identification. Compatibility information is not a substitute for professional installation judgement unless MotoArk expressly confirms fitment in writing.
Where MotoArk expressly confirms a part as compatible based on accurate information supplied by the customer and the supplied part does not correspond with that confirmation, MotoArk will administer the matter as an incorrect-supply claim under the Returns, Refunds & Warranty Policy.
6. Orders and Contract Formation
Product listings are invitations to place an order. Submission of an order does not guarantee acceptance. MotoArk may reject or cancel an order before dispatch for reasons including stock unavailability, pricing error, failed payment authorisation, suspected fraud, seller inability to fulfil, delivery restrictions or legal/compliance requirements.
An order is accepted when MotoArk confirms acceptance or dispatch, whichever occurs first. If an accepted payment cannot be fulfilled and the order is cancelled, the paid amount will be refunded to the original payment method.
7. Prices, Taxes and Fees
Prices are normally displayed in AED and will indicate applicable VAT or other charges where required. Delivery, international duties, special handling, programming or other fees may be added where clearly disclosed before checkout.
If an obvious pricing or system error occurs, MotoArk may cancel the affected order and refund the customer. MotoArk will not intentionally rely on an obvious error to mislead a customer.
8. Payment and Buy Now, Pay Later
Payments may be processed by third-party payment gateways, card acquirers, banks or BNPL providers. By choosing a payment method, you authorise the relevant provider to process the transaction and you agree to any provider-specific terms presented to you.
MotoArk does not control a bank, card issuer or BNPL provider's approval decision, credit assessment, instalment schedule or processing times. Where a refund is approved, MotoArk will instruct the relevant provider; the time for the credit to appear may depend on that provider.
You must use a payment method that you are authorised to use. MotoArk may perform fraud, sanctions and payment-risk checks and may request reasonable verification before fulfilling an order.
9. Delivery
Delivery is governed by the MotoArk Delivery & Shipping Policy and any delivery estimate shown at checkout. Same-day, express or rapid delivery may be offered for eligible products, sellers and locations, but any displayed time is an estimate unless MotoArk expressly guarantees it in writing.
The customer is responsible for providing an accurate delivery address and a reachable contact number. Additional charges or delays caused by incorrect information, failed delivery attempts or customer-requested redirection may be charged where reasonable and disclosed.
10. Returns, Refunds and Warranty
The MotoArk Returns, Refunds & Warranty Policy forms part of these Terms.
- Eligible uninstalled/unaltered parts have a minimum 7-calendar-day return window, unless a longer seller-specific period is displayed.
- Eligible functional used parts have a minimum 30-calendar-day functional warranty, unless a longer seller-specific warranty is displayed.
- A seller-specific longer return or warranty period displayed at purchase forms part of the transaction.
- Installed or electrically connected electronic/electrical parts are generally no longer eligible for an ordinary return but may remain eligible for a genuine defect/warranty claim.
- Mandatory UAE consumer rights are not excluded by these commercial periods.
11. Customer Obligations on Installation and Use
Automotive parts must be installed, programmed, coded and used in accordance with professional automotive practice and any applicable manufacturer requirements. MotoArk may require professional-workshop evidence for installed-part warranty claims, particularly for engines, transmissions, control modules and other complex components.
The customer must not intentionally remove or alter serial numbers, security seals, UV marks, warranty labels or other product-identification measures used to prevent fraud and verify returns.
12. Seller Standards
Third-party sellers using MotoArk are required to comply with MotoArk marketplace standards, including authenticity, lawful sourcing, accurate descriptions, fulfilment, minimum return/warranty protection and cooperation with customer claims.
MotoArk may suspend listings, withhold or set off seller settlements, impose reserves, restrict seller privileges or remove sellers where permitted by the seller agreement and reasonably necessary to protect customers, payment integrity or the marketplace.
13. Reviews and User Content
If you submit a review, photograph, feedback or other content, you must ensure it is lawful, accurate to your experience and does not infringe third-party rights. You grant MotoArk a non-exclusive, worldwide, royalty-free right to use, reproduce and display that content for operating and promoting the Platform.
MotoArk may moderate or remove content that is unlawful, fraudulent, abusive, defamatory, misleading, contains personal data of others, infringes intellectual property or is unrelated to the transaction.
14. Prohibited Use
- using the Platform for fraud, money laundering, sanctions evasion or unlawful trade;
- attempting to bypass MotoArk payment or marketplace processes in a manner that breaches a seller/customer obligation;
- scraping, reverse engineering, interfering with security or introducing malicious code;
- misusing another person's account, payment method, identity or personal data;
- selling or attempting to return counterfeit, stolen, substituted or tampered products; or
- using the Platform in a way that violates UAE law or third-party rights.
15. Intellectual Property
The MotoArk name, logo, software, databases, marketplace design, text, graphics, workflows and other proprietary content are owned by MotoArk or its licensors. No right is granted except the limited right to use the Platform for its intended purpose.
Vehicle manufacturer names, logos, OEM part numbers and third-party trademarks remain the property of their respective owners. Their appearance on MotoArk does not imply sponsorship or affiliation unless expressly stated.
16. Platform Availability and Third-Party Services
MotoArk may rely on third-party payment, identity, catalogue, logistics, cloud, communications and BNPL services. MotoArk will use reasonable efforts to maintain Platform availability but does not guarantee uninterrupted operation. Planned maintenance, cyber incidents, telecommunications failures, force majeure or third-party outages may affect service.
17. Liability
Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer rights and liability arising from fraud or wilful misconduct.
To the extent permitted by law, MotoArk is not liable for indirect, incidental or consequential business losses, loss of profit, loss of opportunity or loss arising from vehicle downtime. For a consumer claim, any limitation applies only to the extent permitted by mandatory UAE law.
For business customers, and to the fullest extent permitted by law, MotoArk's aggregate contractual liability arising from a particular product transaction will not exceed the amount paid for that product, except where a higher liability cannot lawfully be limited.
18. Fraud, Chargebacks and Abuse
MotoArk may investigate suspected fraud, false defect claims, product substitution, abusive chargebacks or manipulation of seller/customer protections. MotoArk may suspend an account, preserve evidence, contest a chargeback, refuse a commercial remedy or refer suspected unlawful conduct to the relevant authorities where reasonably justified and permitted by law.
19. Privacy
Personal data is processed in accordance with the MotoArk Privacy & Cookie Policy and applicable UAE data-protection law. Payment-card information may be processed directly by payment service providers under their own security and privacy frameworks.
20. Changes to the Platform or Terms
MotoArk may update these Terms to reflect changes in law, services, technology or business operations. The version applicable to a completed order will generally be the version presented at the time of order, except where a mandatory legal change must apply. Material changes will be published on the Platform with an updated effective date.
21. Complaints and Dispute Resolution
Customers should first contact MotoArk at info@motoark.com or +971 50 767 7495 and provide the order number and details of the issue. MotoArk will attempt to resolve complaints fairly and promptly and will coordinate with the relevant seller or service provider where applicable.
Nothing in these Terms prevents a consumer from exercising rights before a competent UAE consumer-protection authority or court.
22. Governing Law and Jurisdiction
These Terms are governed by the federal laws of the United Arab Emirates and, where applicable, the laws in force in the Emirate of Sharjah. Subject to any mandatory consumer jurisdiction or statutory right, disputes shall be submitted to the competent courts of Sharjah, United Arab Emirates.
23. General Provisions
- If any provision is unlawful or unenforceable, the remaining provisions continue in effect to the extent permitted by law.
- A failure or delay in enforcing a right is not a waiver of that right.
- Headings are for convenience and do not limit interpretation.
- These Terms, together with incorporated policies and product-specific terms, constitute the applicable agreement for use of the Platform and purchases.
