MotoArk processes personal data in accordance with applicable UAE data-protection law and uses third-party payment/logistics providers where necessary to fulfil transactions.

1. Who We Are

MotoArk FZE operates the MotoArk automotive spare-parts marketplace and related services. For purposes of applicable UAE personal-data law, MotoArk acts as a controller of personal data for many of the processing activities described in this Policy and may also work with sellers and service providers that independently control certain data.

2. Scope

This Privacy & Cookie Policy applies to personal data collected through the MotoArk website, applications, customer support, seller onboarding, orders, deliveries, payments, warranty/return claims, marketing and related interactions.

3. Personal Data We May Collect

  • Identity and contact data, such as name, telephone number, email, delivery address and account details.
  • Business data, such as company name, trade licence, VAT/TRN information, authorised contacts and workshop/garage details.
  • Vehicle and transaction data, such as VIN, make/model, registration-related information where supplied, OEM part numbers, order history, seller, delivery and warranty records.
  • Payment and billing data. Payment-card data is generally processed by payment providers; MotoArk does not intend to store full card numbers or card security codes except where lawfully provided through a compliant payment service.
  • Technical data, such as IP address, device/browser information, cookie identifiers, session data, log data and security/fraud signals.
  • Customer-support content, including messages, calls, photographs, videos, diagnostic reports, invoices and other evidence supplied for fitment, return or warranty support.
  • Marketing preferences, consent records and communication history.
  • Seller compliance and verification data necessary to operate a trusted marketplace.

4. How We Use Personal Data

  • to create and manage accounts and authenticate users;
  • to identify parts, support compatibility checks and process orders;
  • to collect payments, prevent fraud and manage chargebacks/refunds;
  • to coordinate sellers, fulfilment, delivery and customer support;
  • to administer returns, warranty claims and disputes;
  • to verify sellers, suppliers and business customers and meet legal/compliance obligations;
  • to maintain Platform security, detect abuse and protect MotoArk, customers and sellers;
  • to analyse service performance, improve search, catalogue, inventory, pricing and customer experience;
  • to send transactional messages and, where permitted, marketing communications;
  • to comply with UAE laws, lawful authority requests, tax, accounting, audit and dispute requirements; and
  • to establish, exercise or defend legal rights.

5. Legal Bases and Consent

MotoArk processes personal data where necessary to perform a contract or take steps requested before a contract, where required to comply with law, where necessary for legitimate business purposes permitted by applicable law, and/or where valid consent has been obtained. Where processing is based on consent, consent may be withdrawn subject to legal and contractual limitations and without affecting processing already lawfully carried out.

6. Sharing Personal Data

MotoArk may share personal data only to the extent reasonably necessary with:

  • the seller supplying the relevant part and other marketplace participants involved in the transaction;
  • payment gateways, acquiring banks, card schemes and BNPL providers;
  • couriers, logistics providers and fulfilment partners;
  • technology, hosting, cloud, analytics, communications and customer-support providers;
  • professional advisers, auditors, insurers and consultants;
  • government, judicial, regulatory, law-enforcement or consumer-protection authorities where required or lawfully requested; and
  • a buyer, investor, financing party or successor in connection with a genuine corporate transaction, subject to appropriate confidentiality and legal safeguards.

7. Payments and Financial Information

Online payments may be handled by third-party payment service providers. Those providers may collect card, bank, identity, device and fraud-prevention information directly and process it under their own privacy terms. MotoArk generally receives transaction identifiers, payment status and limited payment metadata necessary to reconcile orders, refunds and disputes.

8. International Data Transfers

Some sellers, cloud providers, technology providers or other service providers may process data outside the UAE. Where personal data is transferred internationally, MotoArk will seek to use lawful transfer mechanisms and appropriate contractual, organisational and technical safeguards required by applicable UAE law.

9. Data Retention

MotoArk retains personal data for as long as reasonably necessary for the purposes described in this Policy and for periods required by applicable UAE tax, accounting, consumer-protection, commercial, anti-fraud, legal-claim and regulatory obligations. When data is no longer required, MotoArk will delete, anonymise or securely archive it as appropriate.

10. Security

MotoArk applies reasonable administrative, technical and organisational safeguards designed to protect personal data against unauthorised access, loss, misuse, alteration or disclosure. No online system can be guaranteed completely secure; customers should use strong credentials and notify MotoArk promptly of suspected account compromise.

  • request restriction or cessation of certain processing;
  • object to certain automated processing or direct marketing;
  • withdraw consent where processing relies on consent; and
  • request transfer/portability of data where legally applicable and technically feasible.

12. Marketing Communications

MotoArk may send service-related messages necessary for an account or transaction. Promotional messages will be sent where permitted by law and applicable consent/opt-out requirements. You may unsubscribe from marketing using the unsubscribe method provided in the communication or by contacting MotoArk. Service, security and transaction messages may still be sent where necessary.

13. Cookies and Similar Technologies

MotoArk may use cookies, pixels, SDKs, local storage and similar technologies to operate the Platform, remember preferences, analyse performance, secure transactions and support marketing where permitted.

Where a cookie or similar technology requires consent, MotoArk will provide a consent mechanism or cookie settings. Blocking some cookies may affect Platform functionality.

  • Strictly necessary cookies: required for security, login, checkout, fraud prevention and core website functions.
  • Preference cookies: remember language, location or display choices.
  • Analytics cookies: help MotoArk understand website usage and improve performance.

14. Children

MotoArk services are intended for adults capable of entering into transactions. MotoArk does not knowingly seek to collect personal data from children for purchasing purposes. If you believe a child has provided personal data without appropriate authority, contact MotoArk so that the matter can be assessed under applicable law.

15. Third-Party Websites and Services

The Platform may link to third-party websites or services. Their privacy practices are governed by their own policies. MotoArk is not responsible for third-party privacy practices except to the extent applicable law imposes responsibility on MotoArk.

16. Changes to this Policy

MotoArk may update this Policy to reflect changes in law, technology or operations. The current version will be published on the Platform with an updated effective date. Where required, MotoArk will provide additional notice or obtain consent for material changes.
